Beach Box Real Estate Agent and Professional Referral Programs: Terms and Conditions

Referrals made after the date of the most recent update are subject to the terms and conditions below. Referrals made prior to the most recent update are subject to the terms in effect at the time the referral was made.

Beach Box’s Real Estate Agent Referral Program and Professional Referral Program (each a “Program” and together the “Programs”) allow eligible participants to earn referral compensation by referring new vacation homeowners to Beach Box. Subject to other eligibility criteria, a participant can earn referral compensation when a referred owner signs a Beach Box agreement for vacation rental property management services and the property is available to receive bookings on BeachBoxRentals.com.

Participation in these programs is subject to these terms and conditions. Your submission of a referral through a Referral Landing Page on the BeachBoxRentals.com website (the “Landing Page”) constitutes agreement to these terms and conditions. As used in these terms and conditions, the term “Beach Box” includes Beach Box LLC and any subsidiary or affiliate of Beach Box LLC.

Referral process:

A Real Estate Agent or Professional may participate in the Programs by submitting to Beach Box through the Landing Page the name and contact information (email address, telephone number, and/or mailing address) of a property owner, each a “Referee,” as defined herein.

If a Referee signs an agreement with Beach Box to manage the Referee’s property as a vacation rental (the “Referred Property”) within twelve months after the Real Estate Agent or Professional submits the Referee’s name and contact information to Beach Box, and all other terms and conditions of the Program are fulfilled, Beach Box will initiate payment for the referral to the referring Real Estate Agent or Professional within 30 days from the date the home becomes live and is available to receive bookings through BeachBoxRentals.com. Please allow for 4-6 weeks for payment to be delivered.

Beach Box reserves the right to not compensate a Referrer if the Referee terminates their agreement with Beach Box within 30 days of the Referred Property being available to receive bookings on StayBeachBox.com. Only Referred Properties in the United States are eligible for the Programs. Multi-unit referrals are excluded from the referral program.

Incentive Structure:

At Beach Box, we value our partnerships with realtors and recognize the important role you play in connecting homeowners with exceptional property management services. We are excited to introduce our Realtor Referral Incentive Program, designed to reward you for every new homeowner you refer to us.

Incentive Structure:

- First Home: $1,000

- Second Home: $1,500

- Third Home: $2,000

- Fourth Home and Beyond: $2,500 each

These incentives are available for referrals made within one calendar year. From the date of the first commission payout, you have 12 months to build your commission. At the end of the 12 months, it renews at $0 and you start over.

Referral Amounts for Full-Service Property Management for Real Estate Agents:

For full-service property management referrals made by real estate agents, the referral amount for properties not previously managed by Beach Box is as follows: For full-service property management referrals for properties located in Hawaii, the Standard Referral Amount is $1,500 regardless of the number of bedrooms.

Referral Amounts for Full-Service Property Management for Professionals:

Beach Box will pay the above referral amounts, regardless of the number of bedrooms.

Real Estate Agent Referral Program – Additional Terms and Conditions

Eligible Participants: Real estate licensees in good standing who hold an active real estate license in a jurisdiction in the United States (a “Real Estate Agent”).

Definition of “Referee” for the Real Estate Agent Referral Program: A “Referee” is a referred person who (1) owns a property that is used as, or would be appropriate for use as, a vacation rental, and (2) is not at the time of the referral submission already under contract with Beach Box (or with a predecessor in interest of, or assignor of a contract to, Beach Box) for vacation rental services and is not already engaged in discussions with Beach Box for full-service or limited services.

Disclosure: Any referral submission shall be considered an affirmative declaration by the Real Estate Agent of their eligibility under all applicable laws.

Referral Compensation Paid to Individual: Any referral compensation will be paid to the individual Professional who made the referral.

Additional Terms and Conditions That Apply to Both Programs

Disclosure to Referee: Beach Box may disclose to the Referee the identity of the Real Estate Agent or Professional who submitted the referral to Beach Box.

Multiple Owners, Multiple Properties, and Multiple Referrals: If a Referred Property has more than one owner, only one owner will be treated as a Referee for purposes of the Program. After an initial referral of a Referee, you may be eligible to earn additional referral compensation for each additional separate property owned by the Referee, excluding Multi-Unit properties, if the Referee chooses Beach Box to manage such additional property. These additional referrals can happen all at once or over the 12-month eligibility time period. If more than one person refers the same Referee (or co-owner of a Referred Property with a Referee) to Beach Box, Beach Box will issue any applicable referral compensation to the person who Beach Box in good faith determines, in its sole discretion, was the first to submit Referee’s information to Beach Box.

Documentation Required for Compensation: In order to receive a referral compensation, you must complete a W-9 and Payment Authorization Form, as well as any other documentation reasonably required by Beach Box. If you wish to receive a check versus a direct deposit of funds, a mailing address should be included in the W-9. If you would like to receive payment via direct deposit, a copy of a voided check or a bank letter confirming the routing and account number is required.

Tax Consequences: The Real Estate Agent or Professional is responsible for tax consequences, if any, that arise out of receipt of referral compensation.

Severability: If any provision of the terms and conditions for the Programs is held to be invalid or unenforceable, the validity and enforceability of the remaining portions shall not be affected.

Good Faith: Beach Box may withhold or refuse to pay a referral if it believes, in its sole discretion, that a Real Estate Agent or Professional is acting in bad faith or contrary to the intent of the Programs. Examples include submitting names of owners to which the referring person has no relationship or connection or submitting referrals for properties owned or co-owned by a family member or business partner.

Changes to, and Termination or Suspension of, the Programs: Beach Box may make changes to these terms and conditions, or suspend or terminate the Programs, at any time without prior notice, provided however that to the extent permitted by law, Beach Box will honor any referral that has met all eligibility criteria for a referral compensation as of the date the change, suspension, or termination takes effect. If Beach Box modifies these terms, the changes will be posted on the Landing Page and will be effective upon posting. Continued participation in the Programs following any modification will constitute consent to such modification.
